3 main types of traffic offenses
1
OVI / DUI
When a person is driving while intoxicated or under the influence of alcohol or drugs in Ohio, they can be arrested for operating a vehicle impaired (OVI). An OVI means the same thing as a DUI, DWI, and OMVI because they all target the same types of behavior. You may be convicted of OVI in Ohio if you are driving with a blood alcohol level (BAC) of 0.08 % or more. If you are under the age of 21 and driving with a blood alcohol level (BAC) of 0.02% or more.
If supspected of being under the influence of drugs or alcohol, law enforcement can perform chemical tests on suspecting DUI/OVI offenders. If you are pulled over and are requested to take a chemical test, Ohio has what is known as an implied consent law. This means that if you refuse to submit to a chemical test you will be subject to a fine and automatic license suspension.
2
PHYSICAL CONTROL
Section 4511.194 of the Ohio Revised Code makes it illegal to “be in physical control of a vehicle” while you are “under the influence of alcohol, a drug of abuse, or a combination of them.” The statute also explicitly defines “physical control” as “being in the driver’s position of the front seat of a vehicle … and having possession of the vehicle’s … ignition key or other ignition device.”
Physical control is prosecuted as a first-degree misdemeanor.
A driver who gets convicted of or pleads guilty to a physical control charge can also have his or her license suspended for up to 12 months.
3
RECKLESS OP
According to Ohio Law, reckless operation of a vehicle is defined under Section 4511.20 of the Ohio Revised Code as:
Operating a vehicle
-
without due regard for the safety of persons or property; or
-
in willful or wanton disregard of the safety of persons or property.
A Reckless Operation is a misdemeanor traffic offense that carries four (4) points against your Ohio Driver’s License. Reckless Operation covers a whole host of traffic mishaps, from driving more than 20 miles over the speed limit to striking an inanimate object. There are no mandatory penalties associated with a Reckless Operation conviction.
